'Review of a lifetime' can benefit INSS retirees

With the future a little uncertain, the millions of pensioners in the INSS (National Social Security Institute) do not know what to expect about the judgment of the stf (Federal Supreme Court) in relation to pensions. What is the lifetime review?

The main objective of this revision is to include contributions made before 1994, within the beneficiary calculations. Due to the insertion of the Real Plan, contributions made before this period are not included in the calculations.

If this revision is approved by the ministers, many people may have their benefit amounts modified, and may even multiply the amount in question.

Understand a little more about the situation of retirements:

If the lifetime review is approved by the STF, retirees who obtained benefits granted between 1999 and November 12, 2019 will be able to file a request. Find out which payment methods entitle you to this correction request:

  • Retirement by age;
  • Special retirement;
  • Retirement by time of contribution;
  • By disability retirement;
  • Retirement of the person with a disability;
  • Illness benefit;
  • Death pension.

It is important to point out that this type of correction is not always positive for all INSS retirees. In this case, to better understand your particular situation, it is advisable to ask for the help of a social security lawyer.

How is this process?

Supreme Court justices ruled in favor of retirees in March of this year. Minister Nunes Marques introduced the request for emphasis, with only 30 minutes remaining for the deadline for proclamation of the result.

Earlier this month, the minister president of the STF, Rosa Weber, scheduled a new debate for last Wednesday, 23. However, the Court continued to postpone this discussion and also did not announce a new date to discuss the matter.

The score, so far, is 6 to 5 for retirees, also including the vote of Minister Marco Aurélio, who is now retired. The former minister was replaced by André Mendonça, but his vote remains valid, according to the STF.
