A profession that has been growing for some time in the country is that of motoboys, and after the emergence of delivery apps, these numbers increased on a large scale. In the year 2021, a survey carried out by the Institute of Applied Economic Research (Ipea) showed that the number of motoboys has already exceeded the range of 544 thousand people in Brazil.

Under Law 12.1997/2014, the profession of motoboy is considered dangerous, so motorcycle workers now have the right to special retirement of the National Institute of Social Security (INSS).

During an interview, specialists in social security law explained how motoboys can prove their working time in who are exposed to risk, including those who provide services to companies, such as the self-employed and individual micro-entrepreneurs (MEIs).

“The exposure of the motoboy to the dangerousness of the activity was guaranteed by the labor legislation, opening space for the framework also as a special time” observes Adriane Bramante, president of the IBDP (Brazilian Institute of Law Social Security). She also alerts to the different types of social security payments, justifying the recognition of this period.

The self-employed, who pay 20% to the INSS, need to present receipts or documents that prove the activity as a motoboy. MEIs, on the other hand, have to complete the rate by an additional 15% of the amount, in addition to the 5% that are already paid by them normally.

There is a need to prove exposure to danger in order to be entitled to grant special retirement, upon delivery of the Professional Social Security Profile (PPP). Presenting the work card and paychecks with receipt of the additional payment paid by the employer is an important step.

It should be noted that the PPP is a work history that collects management data, environmental records and biological monitoring results while wage earners engage in hazardous activities in the company. The main objective of the PPP is to inform about the conditions of the work environment, which is fundamental for the application of the special pension in the INSS.

“I don't have a portfolio, but I have a CNPJ and I make my contributions to the INSS because I know that I have the right to special retirement”, reports Thiago Santos da Conceição, 34 years old, who has been a motorcycle courier for 5 years. years. He also points out the dangers of the profession: “There is no paving on the streets, no signage. Traffic is chaotic.”

“I've been working as a motorcycle courier for two and a half years, the last year as a delivery man. Previously, my position was that of stocking goods. The traffic is very violent, it's dangerous everywhere. Every day, all I want is to get home safe and sound to be with my family. It's a lot of tension, risk of accidents, holes in the streets, lack of signs, drivers who throw their cars on top of motorcycles and the constant risk of robberies. It's hard to work like this,” says Jean Tavares, 27, a resident of Penha, in the North Zone of Rio de Janeiro.
