The third type of education used in the country, community schools had the respective legal framework for institutions Community Basic Education (ICEB) already approved by the Federal Senate and which is now under analysis by the Chamber of Deputies.
Due to the difference of being constituted by groups of communities, community schools function as educational cooperatives, with the main objective of developing, through the organization of autonomous professionals and administration represented by the community (parents, students and teachers), quality education services at an affordable price. Currently being processed in the Chamber, as mentioned, the project, according to its authorship, Senator Daniella Ribeiro (PSD-PB), deals with the definition, qualification, prerogatives and purposes of ICEBs, in addition to the terms of partnership with the power public.
Defined as civil society organizations by the text approved by the Senate, community education institutions cumulatively have the following central characteristics:
- Established by groups of individuals or by one or more legal entities that include community representatives in their supporting entity;
- Established in the form of an association or foundation, with legal personality under private law, including those established by public authorities;
- Assets belonging to civil society entities and/or public authorities; It is
- Not for profit.
As they are non-profit, ICEBs:
- They may not distribute any portion of their assets or income, in any capacity;
- They will need to fully apply their resources in Brazil to maintain their institutional objectives;
- They will need to keep records of their income and expenses in books with formalities capable of ensuring their accuracy.
As they must have administrative transparency, such institutions, in the event of extinction, must allocate their assets to a public institution or similar.
To obtain the qualification of community, the institution must provide, in its statute, some norms, such as administrative management to prevent the obtaining of privileges, benefits or advantages personal.
