All benefits granted in arrears must be credited to policyholders from the first day of payment. The Federal Public Prosecutor's Office (MPF), together with the Federal Public Defender's Office (DPU), as homologated by the Federal Supreme Court (STF), defined a period of 30 to 90 days for the INSS to evaluate the requests. Thus, if the body does not comply with the analysis deadline, it must pay interest and monetary correction to the beneficiary.

The objective of this measure is to eliminate the queue, composed of approximately 1.7 million people. Several factors were responsible for this increase in queues, however the Covid-19 pandemic was one of the main causes of this accumulation. Thus, it is estimated that, with this agreement, the structural problem of the slowness of the INSS can be reduced.

What are the benefits on the waitlist?

The number of requests under analysis varies according to the type of benefit. Among them are, in first place, the Benefit of Continued Provision (BPC) with 757,566 requests under analysis. In second place, retirement, with 519,465 requests, and finally, maternity pay with 179,819 requests.

If you belong to any group of these beneficiaries, it is important to pay attention to the deadlines, as they change according to the type of benefit. For maternity pay, it is 30 days, while for pensions and sick pay, 45 days. The deadline for pension for death and reclusion aid is 60 days, and for other benefits, 90 days.
