Countries where abortion is not criminalized
The issue of abortion involves issues that have been discussed for centuries, such as control of women's bodies, religion and public health. As we mentioned earlier, each country adopts specific legislation for abortion, taking into account these and other points.
Colombia
Abortion is no longer criminalized in Colombia since February 2022. With this, women and health professionals will no longer be judged or penalized for this reason until the 24th week of pregnancy. After this period, the pregnancy is still authorized to be interrupted in cases of risk to the mother, rape and fetal malformation.
Mexico
Mexico decided in court, in September 2021, that women cannot be prosecuted for having an abortion, which allowed the legalization of abortion by the Mexican states.
Argentina
Argentina took an important step regarding abortion in December 2020. At the time, a bill was approved that made abortion legal and accessible, free and safe, for women up to the 14th week of pregnancy. However, after that period, the act is allowed only in cases of risk to the woman's life or rape.
South Korea
After a 67-year ban, South Korea decriminalized abortion in 2021. Before, the voluntary termination of pregnancy was only allowed for women victims of rape or in cases of risk to the pregnant woman's life, however, now it is something allowed for all.
How does the legislation on abortion work in Brazil today?
Currently, abortion is considered a crime in Brazil, according to articles 124 to 126 of the Penal Code of 1940. Thus, the woman who aborts can suffer a sentence of one to three years in prison. Abortion is only allowed in the country in cases of rape, risk to the mother's life or severe fetal malformation.
