Currently, there are more than 1 million Brazilian citizens awaiting the granting of INSS benefits. The Continued Benefit Benefit (BPC/Loas) is the one with the highest number of requests, followed by requests for retirement and maternity pay.

Payment of interest for overdue INSS benefits

First, be aware that the INSS can take 30 to 90 days to review requests for retirees. In addition, there are 10 more days for the processing of the request at the Time Emergency Analysis Center (Cemer).

If this period is exceeded, the Institute is obliged to pay interest on arrears, as well as monetary correction. Thus, the amount must be corrected in the first payment of the benefit.

It takes up to 113 days to grant benefits

The definition of interest payment and correction was agreed after an agreement between the government and the Federal Public Ministry (MPF) in June 2021, with approval by the Federal Supreme Court (STF).

However, even with the ongoing agreement, the INSS disclosed to the STF in December 2021 that the analysis time for retirement benefit requests based on contribution time was 113 days.

Late benefit payment simulation

So that you have an idea of ​​how much can be paid, consider that an insured person entitled to a benefit worth the minimum wage in 2021 (R$ 1,100) who had the concession only after six months of waiting would have to receive R$ 6,985.85, with R$ 110.50 being just fees.

Another simulation example is the following: if it took one year to grant the benefit, the amount to be received would be R$ 15,004.54, with R$ 368.91 in interest.

Use of telemedicine to speed up expertise

The INSS edited an Ordinance that allows consultations by videoconference in order to carry out the investigations in ten municipalities in states such as São Paulo, Minas Gerais, Rio de Janeiro, among others. The experience, which is a pilot project, will last for 90 days.
