The Consumer Defense Code does not stipulate a deadline for creditor companies to put the defaulter's name on credit restriction bodies, such as SPC and Serasa. That is, this means that if the debt is overdue for one day, the consumer can now enter the list of SCPC debtors.

Important information about debt arrears
As previously mentioned, the Consumer Defense Code does not determine a deadline for the creditor company to comply with, before putting the name of the defaulter in the credit protection agencies. However, due to the “good relationship policy”, knowing that many people pay their bills with minor delays, a period of 30 days is stipulated before notification to the correspondents.
In order for there to be negation, the defaulter must be communicated by the SPC, or by Serasa. The protection bodies have up to 5 days to notify the customer – this can be done by mail, SMS, email, or phone call.
If the debt is not settled, your name is included on the SPC's list of defaulters. Once notified, the debtor has up to 10 days to contact the creditor and regularize his situation.
After paying the debt, how soon will your name be clean
If the term is met and your debt has been settled or negotiated, the creditor company has up to 5 days to remove your name from the list of defaulters. This should occur even from the first installment of the amount, or the complete discharge of the debt.
In addition to removing the name, it is necessary for the creditor to provide a proof or receipt attesting to the payment of the outstanding debt. If your CPF remains negative, you will need to contact the company requesting the immediate removal of your name from the system.
