Cultural sector guarantees R$1 billion: controversies over the Rouanet Law return to the fore

Time and again, this law causes controversy among people. This year, it was no different. The Ministry of Culture released the funds for the Rouanet Law: R$ 1 billion will cover several cultural projects until the end of January. According to Minister Margareth Menezes, the transfer had been blocked since the beginning of 2022.

Margareth Menezes reinforced that the funds for the Rouanet Law had been stopped since the beginning of 2022. Therefore, for this year, it is expected that around R$1 billion will be offered in investment for cultural creations.

According to the ministry, in the previous government, the resource was raised from sponsors, however, no artist received the benefit that is guaranteed by law. As a result, many planned projects could not be implemented.

The team undertook to carry out all this transfer – which was not done – by the end of this month. Around 1,946 proposals will benefit from this money. In addition to releasing the money, 5,000 projects that had already missed their deadlines were also postponed.

The controversy over the Rouanet Law

Even though it was guaranteed by Justice, many people questioned the fate of so much money for artists. Especially the already known ones like, for example, Cláudia Raia and her musical, since they will receive R$ 5 million until the end of this year. The project in question is complying with the rules of the law, as it offers a guarantee of social compensation.

Despite this, criticism of the decision won the internet.

How it works?

The resource, different from what many think, comes from a tax incentive, that is, the government encourages companies and individuals to invest in the cultural sector, sponsoring events that are released by the Rouanet Law with part of the money that would be used for the payment of Income tax (GO).

In this way, the cultural producer presents the project to the ministry.

If it is within the norms established by law, it goes through a technical commission. From this, the project is authorized to get sponsorship from private initiatives by the Rouanet Law. Then, the producer has up to one year to get a sponsor, who will benefit from deducting the value from his IR.

The money does not come directly from the government.

The resources come 100% from the private sector, which sees in the law a way to receive a tax benefit. In some cases, in addition to the tax benefit, those who invested also receive a lot of publicity with these projects.

Investors seeking the law deposit the money in an account at the Ministry of Culture with an already foreseen destination. Then, they withdraw the receipt to deduct the value from the IR. Therefore, it is important to point out that the money that will be invested until the end of January is already available in this account.
