Senate approves new rule for granting retirement for dangerous work

On Wednesday (10), the plenary of the Senate unanimously approved a complementary bill that establishes the norms for special retirement due to dangerous work. There were 66 votes in favor and none against.

The project determines the eligibility criteria for insured persons of the General Social Security System (RGPS) who are exposed to substances or risk situations because of their professions.

Now that it has been approved in the Senate, the project is going to be analyzed in the Chamber of Deputies, where it has a great chance of also being approved.

According to the Complementary Law Project (PLP) 245/2019, which is the text that was discussed now, they will be entitled to special retirement policyholders who are effectively exposed to chemical, physical and biological substances harmful to health.

The list of dangers to the worker was delivered in advance by representatives of the Executive Branch. In addition to clarifying the danger, the text also establishes a minimum period of 180 months of contribution to qualify.

In addition, the project provides for different requirements for policyholders who joined the RGPS before and after the pension reform, approved in 2019. For those who joined before the reform, there are three possibilities, which are based on a points system:

  • Have the sum of age and contribution time equal to 66 points, with 15 years of effective exposure;
  • Have a sum of 76 points with 20 years of effective exposure;
  • Have a sum of 86 points with 25 years of effective exposure.

For those who started contributing after the reform, there is no point system, but minimum age requirements. The options are:

  • Be 55 years old, with 15 years of effective exposure;
  • Be 58 years old, with 20 years of effective exposure;
  • Be 60 years old, with 25 years of effective exposure.

Readaptation period and exposure limits

The proposal approved by the Senate establishes the obligation of companies to readjust professionals who are exposed to harmful agents to health, guaranteeing job stability after the maximum period of exposure to these substances. The text also includes a sanction for companies that do not keep up-to-date records of activities.

In addition, the proposal details the classification of certain activities, such as underground mining, surveillance overt, transportation of values, services related to electricity and explosives, according to the effective time of exhibition.

In the case of underground mining, workers who work on the production line can work for a maximum of 15 years. If there is exposure to asbestos or other harmful chemicals, the maximum period is 20 years.

Activities that involve risk to physical integrity will be equivalent to activities that allow exposure effective for up to 25 years, provided that these activities are related to overt surveillance and other practices.

The project also foresees the payment of indemnity compensation, to be carried out by Social Security, corresponding to 15% of the contribution salary, when the insured person is exposed and has already reached the minimum period of contribution.

Finally, it is included in the text of the Bill to complement the granting of special retirement to public security agents, such as police officers, security guards and others who work armed or not in environments with large circulation of people, such as subway stations or bus.
