The death of a loved one is something that generates several changes in the lives of those closest to the deceased. In addition to having to overcome the grief of the loss, many are economically helpless, as they are financially dependent on the person who died.

In this sense, some rights are guaranteed to these individuals, to alleviate the difficulties faced. Therefore, it is the right of the heirs to receive the FGTS and the PIS/Pasep salary bonus from a beneficiary who dies.

Who can withdraw the money?

The Brazilian civil code provides in its article 666 that the right to redeem the FGTS and the salary allowance for heirs of deceased persons is guaranteed. In addition, Law 6.858/80 also provides for this right. So, this means that everything that the beneficiary did not use in life can be withdrawn by those who are entitled, as long as that person is a valid dependent.

The people who have the right to redeem this money are: wife or husband, parents, sons and daughters, brothers, nephews, uncles and cousins. In the case of cousins, it is only accepted if they have a relationship of up to 4th degree. In addition, it is not any one of these people who can withdraw this money, being a priority for the spouse, parents and children.

How to withdraw FGTS and PIS/Pasep?

The money can be withdrawn whenever the dependent wishes. However, to do this, you will need to go to a Caixa Econômica Federal branch and present some documents. Are they:

  • Beneficiary's death certificate;
  • Identification document of the person withdrawing the amount;
  • Declaration of qualification of the dependents to receive Social Security pension or a court order that proves the dependency of the deceased person;
  • In the case of underage dependents, bring a birth certificate or identity card and CPF to open the savings account;
  • PIS/Pasep registration;
  • Employment card of the beneficiary who died;
  • In cases of non-employed director, it is also necessary to take a copy of the dates of the meetings that can prove election, reappointments and termination of terms.
