Who is entitled to sickness benefit
Basically, the Disease Allowance is a benefit distributed by the National Institute of Social Security (INSS) for policyholders who are unable to carry out any work, either temporarily or total. In these cases, workers can appeal due to some illness or accident, whether or not the fact occurred at work. Indeed, this is a concern that has become greater during the last two years, since the covid-19 pandemic has made it impossible for thousands of Brazilians to perform their duties.
Therefore, the unemployed can indeed receive the aid, but they must be in the “grace period” (when the person is considered insured, even if they no longer contribute to the INSS). Including, when leaving the job, each individual stays for 12 months in that period. However, if he has 120 uninterrupted contributions or more, this period may rise to 24 months. Still, you need to undergo a medical expertise to prove your condition.
Requirements for receiving sick pay
- Minimum grace period of 12 months: As stated, a grace period of 12 months is required. However, in some cases it is not required, as in: accidents at work; illnesses acquired during service; serious illnesses such as blindness, AIDS, Parkinson's disease etc.
- Total or temporary disability: The citizen cannot be able to work and this must be proven through medical expertise. In this case, this assessment will be made by a Social Security professional.
- Quality of insured: In order to be insured, it is necessary to have contributed to the INSS (as an employee or taxpayer individual), be in a grace period or receive any social security benefit, with the exception of Accident Assistance.
