The death pension is one that everyone already knows about. This is a benefit of a social security nature paid to the dependents of the deceased insured person, whether or not he was retired before his death.
This benefit will increase by 10% for each dependent (who is a child) left by the deceased until they reach 21 years of age. Beyond that age, the heirs lose the right to the pension, except for disability or disability (as long as it persists).
Thus, to receive 100% of the pension, the deceased must leave at least five dependents. Furthermore, it is important to note that this benefit cannot be less than the minimum wage.
How to withdraw FGTS and PIS/PASEP?
The system for these benefits is the same and there are two laws that apply in this case. For this, we have article I of Law nº 6858/1980 and article 666 of Law nº 13.105/2015.
Thus, in order to carry out the withdrawal, it is not normally necessary to open an inventory after the worker's death. In addition, the widowed spouse who is eligible as a dependent and is listed in the INSS can make this withdrawal at any time.
