Tax exemption for photographic equipment
The proposal approved by the Senate specifies that photographic devices will be subject to Import Tax, Tax on Industrial Products (IPI) and contributions to PIS/Pasep and Cofins. Thus, the benefit is valid only for cameras and accessories that do not have a national equivalent.
The Senate passed the Orlando Brito Law to honor the photojournalist for his contributions to documenting Brazilian political history. The photographer recorded the lives of 15 presidents of the Republic before passing away, on March 11, 2022.
How does the exemption for photographic equipment work?
Although it was considered to offer the benefit to companies, this amendment was not approved, and today it is reserved only for individuals. In order to obtain certification, the professional must present a declaration that there is no comparable equipment on the national market, as well as proof of professional practice.
The applicant must present a valid work card or a signed employment contract. In the case of a public servant, a certificate issued by the organization's personnel department must be presented. In the case of the self-employed professional or service provider as a legal entity, it is necessary to present proof of payment of the contribution to the INSS.
In addition, the total value of all products purchased with the exemption cannot exceed R$50,000. Beneficiaries must keep the equipment for at least two years, except in case of accident, theft, loss or theft.
In some cases, an identical product may be eligible for a new exemption. If the rules are not followed, all taxes will be paid with interest and penalties.
