3 consumer rights unknown by most

Always keep these three questions in mind so that your rights are never ignored again.

1. Waste rate in restaurants

It is super common for some restaurants, especially in rodízios, to charge customers a “waste fee”. Therefore, countless people end up paying without being aware that this is an abusive practice. Restaurants usually impose the fee because they are not aware of the Consumer Protection Code.

Article 39 of the CDC says that: “it is prohibited for the supplier of products or services, among other abusive practices: to demand from the consumer a manifestly excessive advantage”. This issue that the article addresses is precisely this undue charge – in this case, the waste rate – for services not provided, generating an unjust enrichment of the supplier and putting the consumer at a disadvantage exaggerated.

It is worth mentioning that even if there is prior notice on the menu and from the restaurant attendants, they cannot apply this fee. If the consumer is charged by the establishment, he can sue the restaurant and receive double the amount. In some situations, you can still claim compensation for moral damages.

2. entry with food

It is very common that at events and in some establishments – cinema, theater and park – people are prohibited from entering with snacks purchased elsewhere.

This restriction without legal basis is made precisely so that the customer consumes in their own environment, something that many prefer not to do since most of the time everything is more expensive. Without knowing their rights, people comply with such an order and end up losing the money spent before, as well as wasting the food.

This practice is also considered abusive, since by barring the entrance with snacks from outside, the consumer is restricted to consuming from the establishment. This imposition is prohibited.

It is worth mentioning that some items can be really vetoed, as they have a packaging that can provide some risk to the public, such as glass bottles, cans or other objects sharp.

3. Lost parking ticket

It is not uncommon to find people who despair when they lose their parking ticket, as many establishments charge a fine for this loss. However, this obligation is not part of any article in the CDC, so it is considered an abusive practice, since the supplier profits too much from the consumer.

In this situation, what really should be demanded is the charge only for the period in which the consumer was actually in the establishment. If the ticket is a card, it is also necessary to pay the cost of the object.
