Despite disappointment, Japanese decision on gay marriage still up for debate

On Thursday, August 8, the Japanese court issued the final result stating that same-gender marriage is unconstitutional.

Despite the negative response, the court also expressed concerns regarding the dignity and human rights of same-sex couples.

The review was carried out by the Fukuoka District Court, a week after another District Court declared the ban on same-sex marriage unconstitutional.

This turn of events bolstered the hopes of the LGBTQIA+ community in Japan, which is the only Group of Seven nation without legal protections for same-gender unions.

This decision disappointed people who fight for the civil marriage of homoaffective couples, who certainly hoped for a greater advance in terms of equal rights.

Still, the Court's position is considered a step forward and the debate around LGBTQIA+ rights in the country is likely to continue.

Japanese court denied 5 same-sex marriages

In the last two years, Japan has been the scene of five court rulings related to same-sex marriage.

Of those decisions, two concluded that the ban was unconstitutional, one affirmed that it was not, and two, including this week's recent decision, have maintained the ban but raised concerns about other rights.

Opinion polls have revealed that approximately 70% of the Japanese population is in favor of same-sex marriage. Despite this widespread public support, legal rights and protections for same-sex couples in Japan are limited.

Currently, more than 300 municipalities in Japan, which make up about 65% of the population, allow same-sex couples to enter into partnership agreements.

It seems to be a positive tone for the fight, but these agreements do not give couples the same rights as traditional marriage.

Partners do not have the right to inherit each other's property in the event of death, nor do they have rights to children or hospital visits.
