The justification she gave for entering the lane intended for more than one passenger was that she she was late picking up her six-year-old son from school when she was stopped by the police and fined. When the officer asked if there was anyone else in the vehicle, she replied, “Yes. My baby is right here”, pointing to her belly. “She is a person”.

The police officer, not accepting the justification, said that the regulations applied to the track considered as “persons” those “outside the body”, proceeding with the application of the fine.

In an interview with the Washington Post newspaper, the woman, questioning the decision, said that she would have used the law against abortion as an argument against ticket: "I thought [being stopped by the police] was a strange thing and said 'with everything that's going on, especially in Texas, a baby has a person".

Although she used the discussion of legal abortion as an argument, she said that she believes that women she should have the right to choose over her bodies: "That doesn't mean, however, that I'm pro-life either."
