What is grace period?
In short, the grace period is the minimum contribution time that a person needs to have at the INSS to get aid. In this case, Social Security requires at least 12 months of contribution for someone to be able to access benefits such as Disability Retirement or Sickness Aid.
However, there are some cases in which there is a sense of urgency, such as serious illnesses, and then the INSS suspends the need for the grace period. However, it will still be necessary for the worker to be in an insured condition.
This condition concerns registration with Social Security so that the request can be released. Thus, people who receive some benefit from the Government, who have a formal contract or who contribute to Social Security are insured.
As for this last criterion, it is worth mentioning that the Social Security understands that a minimum of 12 months is not necessary for someone to access the benefits. This will happen if the worker develops some kind of serious illness or suffers any accident in the workplace that leaves him or her disabled.
Diseases that exempt the grace period
The Sickness Aid is the way in which the INSS offers security to workers who face a temporary illness. When more than 15 days of leave are exceeded, the Social Security seeks to carry out a new investigation.
Then, if the permanent state of illness is confirmed, there will be a transformation from Sickness Allowance to Disability Retirement. However, in the case of the following diseases, the twelve-month grace period of contribution is unnecessary due to its urgent nature:
- Active Tuberculosis;
- Cancer;
- Mental Alienation;
- Leprosy;
- Irreversible and Disabling Paralysis;
- Blindness;
- Annihilating spondyloarthrosis;
- Severe heart disease;
- Parkinson's disease;
- Severe nephropathy;
- Osteitis Deformans;
- Severe liver disease;
- Radiation Contamination;
- AIDS.
