Is retirement by age and without contribution time possible?

There is no retirement by age without contribution time to the INSS. With this, Social Security created the category of special insured for workers with activities different from those that exist in urban centers, that is, individuals residing in rural properties and working individually and/or in agricultural activities or in a family economy regime, and who through them earn their own livelihood or that of their family.

Some examples are:

  • Rural tenant;
  • Seated;
  • Borrower;
  • Granted partner or sharecropper;
  • Small producer;
  • Possessor;
  • Owner; or
  • Usufructuary.

Workers as special insured, until October 1991, did not need to contribute to the INSS to retire by age. Thus, it was enough to certify the age, time of contribution and the activity carried out.

However, since November 1991, a contribution to the INSS is required. As a result, all special insured persons who sold their production, or a good part of it, began to contribute to Social Security with a percentage of 1.3% on the gross value of the products.

Citizens who have a rural period until October 1991 will be able to use it in retirement. Including, it can be counted even before the age of 12, as recently recognized by the STJ.

The conditions for the special insured person's retirement are:

  • 180 months of contribution time;
  • Male: 60 years old;
  • Female: 55 years old.

Indigenous peoples and quilombolas have a different way of living, as they survive with what they produce in their lands or with handicrafts. In this case, proof of contribution time is different.

The contribution to the INSS is not required, provided that the indigenous person proves that he has the certificate provided by FUNAI with the identification of the entity and its issuer, category in which the producer fits, personal qualification, way of acting in the rural activity and document information provided. Quilombolas must also meet these requirements.
