FGTS review awaits STF vote to be approved

For workers who work with a formal contract since 1999, request the FGTS review (Employment Time Guarantee Fund) can be a way to increase your benefit. This is a very old subject, but it has gained more and more strength as Brazilians have been acquiring knowledge on the subject.

In an action that was filed with the STF (Federal Supreme Court), the withdrawal of the Referential Rate (TR) is requested as a calculation basis to correct the FGTS balance. This is because, as we have inflation above the income that this rate guarantees, resources begin to lose value over time.

In this sense, the main objective of the action is to replace the TR with an index capable of keeping up with inflation, such as the National Consumer Price Index (INPC).

In view of this, in 2021, expectations were high that the Court would vote on the text, but it ended up being removed from the agenda. Since then, workers have been waiting for a decision on this matter.

However, approval is only depending on six favorable votes from STF ministers. If that happens, all the processes that are already in court to correct the value of the FGTS should generate good monetary corrections for many Brazilians.

In order to find out the amount to be received if the correction is approved by the STF, the person needs to have the extracts from the periods in which the FGTS deposit was made. This document can be requested at Caixa Econômica Federal branches or also downloaded via the internet, on the FGTS website or application.

Finally, once this is done, just look for a social security lawyer to calculate the new values. In addition to assisting with the accounts, the professional may also file a lawsuit in court, if it is in the interest of the worker.
