However, it turns out that the information was distorted and ended up taking a series of criticisms to the Senate since the decision does not affect the free public transport for the elderly.
Last year, the Federal Government released R$ 2.5 billion in an emergency measure so that municipalities could pay for free tickets for the elderly, resources that usually come from the states. However, this amount from the Federal Government was released through a Provisional Measure that is valid for only 6 months.
Thus, as it was an emergency measure, it would not continue. That's when Pacheco let the MP expire without the need for a vote for it to be overturned.
However, this does not affect the legislation that determines free passage and those responsible are still obliged to bear all these costs. In short, the elderly will continue to have the right to free transport.
Understand how a provisional measure works
The provisional measure is an instrument used by the President of the Republic in Brazil to issue norms with the force of law in cases of urgency and affinity. It is regulated by Federal Constitution of 1988.
The provisional measure is temporary in nature and takes effect immediately after its publication in the Official Gazette of the Union, but it needs to be approved by the National Congress within 120 days for it to become a definitive law.
If it is not voted on within this period, it loses its effectiveness retroactively from the 61st day after its publication.
