How the INSS attestation analysis will work by application
The approval came after the publication of an Ordinance that established new rules for granting benefits. Among them, the waiver of issuing a conclusive opinion from the Federal Medical Expertise in cases of incapacity for work under the insurance. According to the Ministry of Labor and Social Security, this type of service will not be available in all cities. The virtual procedure will only take place in places where the time between scheduling and carrying out the medical examination is greater than 30 days.
Information from the medical certificate to be analyzed
The Ordinance defined all the topics that must be included in the documents that will be presented for granting the benefit. As for the medical report, it must be legible, without erasures, with the full name of the applicant, date of issue (which cannot be greater than 30 days before the date of submission of the application). In addition, it must contain information about the disease or the CID, if any, signature and stamp of the physician with active registration with the Class Council and the start date and estimated term for the end of the removal.
Can those who already have a marked expertise switch to virtual analysis?
The insured person who already has a date for carrying out the expertise may switch to document analysis. However, this is only possible if the date of issuance of the medical report or certificate is not more than 30 days from the date on which you opt for document analysis. Thus, the observance of the actual date of entry of the application will be guaranteed.
How long will benefits be granted?
The benefits granted through the analysis of the certificate will not last longer than 90 days, even if not consecutively. Furthermore, if there is a request for a new benefit through the analysis of the report, this can only be done after 30 days of the last analysis made.
Problems with marking the expertise
With the Covid-19 pandemic and the interruption of work at the National Institute of Social Security (INSS), many pension insureds were harmed by not being able to schedule the expertise to obtain benefits. However, this situation should improve now with the approval of the new Ordinance.
