“Removing bureaucratic obstacles in order to allow access to the right to higher education is an obligation of the public administrator and, consequently, of the magistrate in the judicial control of the legality of administrative acts", reported Federal Judge Yuri Guerzé Teixeira, of the 2nd Federal Court of Campo Big.
This speech refers to the premise that the Federal Court decided, in a favorable way, to allow a student from the Psychology course at UFMS (Federal University of Mato Grosso do Sul) to start a new higher education course at the same institution before finishing graduation current, keeping, therefore, in two courses at the same time.

In this sense, taking into account Law n. 12,089/09, the university could not allow a student to occupy two vacancies simultaneously in the same institution of higher education. That is, if the student were to enroll in the Literature course, she would automatically lose the enrollment in the Psychology course, which she was already in the last semester.
It turns out that the student managed to pass first in the National Higher Education Examination (ENEM) in 2018, moving then the lawsuit to prove that all that was left was to defend his course conclusion work (TCC) in the graduation of Psychology. Therefore, with the positive endorsement, the young woman was able to enroll in the Literature course and defend her TCC to complete her graduation in Psychology.
Finally, the Judge's decision ensured that the young woman continued studying, enabling her to exercise her rights that were being neglected by a bureaucratic obstacle.
