Facebook: 8 million Brazilians will be compensated for security flaw

Recently, the Diffuse and Collective Interests Court of São Luís (MA), through the Court of Justice of Maranhão, condemned the Facebook to indemnify more than eight million Brazilians who were affected by the data leak in 2021, which occurred in several countries.

”Even after becoming aware of the incident, the defendant [Facebook] did not notify the affected users, did not indicate the technical and security measures eventually adopted to data protection, did not point out the risks related to the incident, nor did it inform the measures to be adopted to reverse or mitigate the damage resulting from the leak of data."

The titular judge Douglas de Melo Martins decided, last Thursday (23), to use the LGPD (General Data Protection Law) as the basis of the argument. Thus, Ibedec's request was partially accepted and Facebook was ordered to pay R$ 500 for each Brazilian who was exposed in the leak.

The total amount of the fine amounts to just over BRL 4 billion (originally, the agency had asked for the payment of BRL 20,000 for each person, which would lead the social network to disburse BRL 160 billion).

The compensation that Facebook will have to pay is R$ 72 million for collective moral damages to the State Fund for Diffuse Rights, in addition to 10% of the judgment amount for payment of court costs and lawyers' fees from Ibedec.

Facebook can still appeal the sentence, which must be complied with in all instances, while affected users will need to request compensation.

It is possible to find out which online tools your email or phone was leaked through the website, which offers details on the date on which this happened. It is essential to check whether Facebook is on the list.
