Public servants now have new rules for migrating to telework in the Federal Government, that is, for the remote work. After the publication in the Official Gazette of the Union on Friday, the 13th, the Ministry of Management and Innovation revoked the previous provisions edited by the Ministry of Economy, in the management of today ex-president Jair Bolsonaro.

With change, the Normative Instruction published in the DOU changes the rules for civil servants of the Union to adhere to the remote work model. In this way, categories were created with preference to migrate to the new regime.
As determined by the Ministry of Management and Innovation, those who have preference in migrating to the remote regime are:
- Disabled people;
- People with serious health problems, who are parents or who act as legal guardians of people in the same condition;
- Public servants with reduced mobility, according to Law n. 10.098/2000;
- Pregnant and lactating women, while the pregnancy and breastfeeding period lasts;
- Servants working with special hours, provided for in paragraphs 2 and 3 of art. 98 of Law no. 8.112/90.
The Normative Instruction also determines that each federal agency must create Declaration Generating Programs (PGDs) and Management and Performance Programs.
3 months is the deadline for regulation
In the document, there is guidance for the bodies of the Civil Personnel System of the Federal Administration (Sipec) and the System of Organization and Institutional Innovation of the Federal Government (Siorg) issue new regulations within 90 days to implement general rules for the telework.
As the Normative Instruction determines the creation of new Management Programs, until there is the new document, the programs created so far remain in force with the application of the norms foreseen in the Decree n. 11.072/2022.
The period provided for in the Normative Instruction for the creation of new rules is up to 90 days.
The rules of the Management Programs were changed in December 2022 by the Ministry of Economy. At the time, a six-month deadline was established for different changes to be implemented within the scope of the federal public service, such as migration to remote work.
