Contran changes rules for electric bicycles in Brazil; know more

In a recent decision, the National Traffic Council (Contran) passed a resolution that brings significant changes to motorized bicycle owners.

One of the crux of the debate was whether electric bicycles should be equipped with a speedometer and mirrors. In addition, topics such as mandatory safety equipment and the National Driver's License (CNH) for mopeds were discussed.

What changes with the new regulation

The main points of the new resolution are:

  • With the new resolution, vehicles that reach 50 km/h, with an engine of up to 50 cm³ and two or three wheels will be classified as mopeds;
  • All electric bicycles running on Brazilian roads must be equipped with a system that only activates the motor when the driver is pedaling;
  • A series of mandatory safety equipment was established for these vehicles. These items are: speedometer, horn, front and side lighting or night signaling and also rear-view mirrors;
  • For mopeds, such as compact motorcycles and scooters, the need for vehicle registration, licensing and registration was defined;
  • Also for mopeds, it will be necessary to obtain an authorization to drive mopeds (ACC) or a national driving license (CNH) in category A.

Who will be responsible for supervision?

As usual, the obligation to monitor compliance with traffic laws lies with the competent local bodies. In this case, it is the responsibility of the National Traffic Department (DENATRAN), which coordinates the Detrans of all Brazilian states.

In addition, the military and road police will also play an important role in this inspection, as in the case of carrying out blitzes and imposing fines.

Failure to comply with the new rules can generate penalties, as defined in the Traffic Code, which may include fines, points on the license and vehicle retention.

When does the new regulation come into effect?

The resolution will come into effect from July 1, 2023. The only exception is for vehicles that are being sold and do not yet have the code, model or version required for registration. In that case, owners will have until December 31, 2023 to comply with current regulations.

Contran's expectation is that the new measures optimize the traffic Safety, both drivers and pedestrians. Furthermore, these guidelines are expected to encourage the responsible use of these vehicles in the country.
