What were the changes to the law?

In relation to the current legislation, there were not many changes. The main difference is that all the other guidelines (453/13, 680/17 and 846/21) were merged into just one. Therefore, since the beginning of April, all the old resolutions have become the same, 940/22.

In this case, the new norms are directed at the use of helmets by passengers and pilots of motorcycles, motorized tricycles, motorized quadricycles, mopeds and scooters. However, these same rules do not discipline cases of piloting or occupying a vehicle with three wheels with a closed cabin.

What are the main changes in helmet use?

Some standards remain the same, such as the mandatory use of a suitable visor for the helmet. In cases of models that do not have this item, very well maintained goggles must be used. Even, contrary to what many believe, the use of sunglasses or eyeglasses cannot replace the motorcycle visor.

In addition, according to Contran, it is now essential that the vehicle has Inmetro certification and has with safety devices on the sides and back of the helmet, like the retro items reflective. In addition, all persons in the vehicle must have the helmet secured to their head using the chinstrap and the hook under the lower jaw.

Failure to wear a helmet can result in a fine of BRL 293.47 and suspension of the National Driver's License, removing the right to prohibit. Also, if the item does not have the specifications mentioned above, the fine is around R$ 193.23.

When the motorcyclist drives a passenger without the helmet being properly attached to the head, without the jugular belt and the coupling in the jaw, the fine is considered light, with the value of R$ 88.38.
