PL wants to prevent animal aggressors from entering public office

A new bill was filed at the Chamber of Deputies. It aims to modify the current Environmental Crimes Law, Law n.º 9605/1998, which makes it a crime to abuse, mistreat, injure or mutilate any animal, domestic or wild. Currently, the law punishes with imprisonment from three months to one year, in addition to a fine. In this sense, the new bill wants to prevent the entry into public office for 10 years for those convicted of this crime.

The Environmental Crimes Law, which deals with mistreatment of wild and domestic animals, punishes the aggressor with imprisonment from three months to one year and/or a fine.

In 2020, this law received an aggravation of penalties in cases where aggression occurs with cats or dogs, becoming 2 to 5 years, ban on custody and fine.

A new bill wants to further increase the penalty for this type of crime. Bill No. 218/2023 plans to prohibit the entry into public office of people who have already been convicted of the crime of mistreatment of animals.

According to the project, which is already filed in the Chamber of Deputies, the ban would be for 10 years, counting from the date of conviction.

The project will increase the penalty of the already known Environmental Crimes Law. It was proposed by Congressman Fred Costa (Patriota-MG) and delegate Bruno Lima (Progressistas-SP).

According to the deputies, the aggravating factor created by Law n.º 14.064/2020 was not enough to stop the mistreatment of animals, since the number of cases did not reduce.

Still according to them, this type of conduct is inadmissible in the Democratic State of Law. In addition, it is unacceptable for an animal aggressor, who disrespects the laws, to assume a public role.

Inspiration of the bill

The idea of ​​the PL of the deputies comes from Law n.º 3940/2022, a state law of Acre. The principle of the law is quite similar and is based on the prohibition of holding public office for people accused and convicted of the crime of mistreatment of animals.

In this sense, deputies want to federalize this law so that it can apply in all states.

Law progress in the House

The bill has already been filed by the deputies in the Chamber, but awaits dispatch from the President of the House. It will then undergo analysis by the House's specialized committees, making it subject to change.

After the amendments, the PL returns to the Chamber for voting and, soon after, it goes to the President of the Republic to sanction or veto the Law.
