License plate law comes into force, causing confusion and imposing a fine of R$ 293.47

Since the 27th of April, the Law 14.562/23 entered into force, bringing changes related to vehicle plates. Like all novelty, information is capable of generating an inconvenience in the face of changes, which has been happening among drivers.

Videos and texts appeared on social networks stating that driving a vehicle without a license plate is a crime, punishable by three to five years in prison, as “guided” by Article 311 of the Penal Code.

The difference is that the article used for this purpose is wrong, as it concerns changes made to the monobloc, chassis or on the identification plate on the vehicle without appearing in the documentation, as it really should to be.

New CTB law

In practice, Law 14.562/23 brought an important change to Article 311 of the Penal Code. The new legislation now provides for specific punishment for tampering with the identifying sign of trailer and semi-trailer vehicles.

This change seeks to expand protection and combat illicit practices related to these types of vehicles. It is an important measure to strengthen the security and integrity of the vehicle identification system as a whole.

The new law expanded the scope of potential offenders and criminalized conduct. Now, those who acquire, receive, transport, hide and the like will be punished under the new law, with the guarantee of a fine of R$ 293.47. With this, the legislation covers a broader spectrum of illicit activities related to the adulteration of vehicle signals.

According to the new CTB law, the prison sentence of three to six years is applicable in cases where the defendant is convicted of carrying out the following conducts: selling, sell, reassemble or use a vehicle with an adulterated or incorrect monocoque number, chassis or identification plate, whether electric, hybrid, semi-trailer or trailer.
