INSS needs to adopt measures after accusation of paying benefits to deceased

An accusation was made by the Federal Court of Auditors (TCU) against the National Institute of Social Security (INSS) for spending BRL 27 million on policyholders who have already died. In their entirety, the payments undue amounts reach R$ 80 million, R$ 53 million exceeding the ceiling of the General Social Security System (RGPS), whose value is R$ 7,087.22.

According to information from the TCU, more than 8,000 benefits had been paid by the INSS in 2021 for people who had already died. Today, the INSS monthly pays 36 million social security benefits.

Furthermore, the audit carried out by Aroldo Cedraz, Minister of the TCU, showed that it was done a payment of BRL 329 million above the salary ceiling for STF justices, which is BRL 39.2 thousand.

The TCU also determined that the INSS install measures to make it impossible to grant social security benefits to people who have already died. Thus, the institute must adopt measures to avoid the payment of amounts whose ceiling for the contribution of the RGPS is exceeded.

This decision was established on June 22 and the INSS has a period of 150 days for the measures to be presented. The government body should also analyze and verify the responsibility of the registry offices that sent the incomplete or even out-of-date death information, which ended up causing wrong.

By law, notary offices are required to report deaths within 24 hours of being registered. This information needs to be forwarded to the SIRC (National Civil Registry Information System).

Some time ago, the average time in which information was passed on reached 40 days, which changed after the creation of the System Control of Deaths (SISOBI), which today is responsible for collecting death data from the registry offices civil.

People who have been contemplated with undue payments will be notified through letters by the INSS, and will have the obligation to return the amounts received. However, if there is a refusal to return it, they may be liable for criminal proceedings.
