Hershey's responds to lawsuit over excess lead in products

A recent survey, which can be view here, reported that some dark chocolates contain heavy metals, including some products from Hershey's, and the frequent consumption of these substances can be very harmful to pregnant women and children.

In the December 15 post, it was revealed that among the 28 bars tested, all had at least some amount of lead and cadmium. More worryingly, 23 of those 28 bars had more of the substance than is considered safe to ingest, according to the state of California's ordinance on the maximum allowable dose.

Thus, it was reported that, although the consumption of this type of substance is more dangerous for pregnant women and children, the risks are not limited to them, as people of any age are subject to the dangers of excessive consumption of cadmium and lead.

National Confectioners Association, responsible for promoting the products, informed that the products are within the legal specifications and are still safe for ingestion. However, a consumer has already filed a lawsuit against Hershey's, claiming that the company misled customers by not correctly disclosing the amount of metals in its products.

Christopher Lazazzaro used the aforementioned study as a basis for the lawsuit, claiming that he would never buy the products if knew of the presence of these heavy metals in their compositions, as well as if they knew the risk they would be exposing themselves to by ingesting these products.

The lawsuit specifically cites three of the brand's products, two of which are from the Lily's brand, which Hershey's acquired in 2021 for more than $400 million. The three chocolate bars were tested and found to contain a large amount of metals, one of which contained 265% more than what is tolerable in California, for example.

Ultimately, Lazazzaro is asking for $5 million in damages, as well as an additional return of at least $500 for each individual purchase.
