Justice canceled IBGE obligation to include LGBTQIA+ issues

Federal Justice discontinues the obligation of IBGE(Brazilian Institute of Geography and Statistics) introduce questions about sexual orientation and gender identity in this year's Census.

Judge José Amilcar Machado, president of the Federal Regional Court of the 1st Region, was responsible for making the decision. According to the journalism team of the G1 news portal, the suspension was established last Friday (24), however, the IBGE only pronounced last Monday (27).

“The IBGE will only comment on the suspension of the injunction by the Federal Court of Acre, by TRF1, after the AGU has been summoned and the decision has been examined”, says the institution's note.

The IBGE disagreed and filed an appeal against the decision taken by the Federal Court of Acre, which determined that the Census, which has not taken place since 2010, should have questions about sexual orientation and identity of gender. Judge José Amilcar Machado explained that the IBGE demonstrated that it was not possible to implement such questions in the form on the eve of the start of the survey.

The judge, however, highlighted the importance of carrying out an advance plan so that issues of the LGBTQIA+ community are included in the next surveys.

“I repeat, therefore, that the present decision is restricted to managerial and temporal aspects, since the beginning of the Census is at hand, and its non-occurrence, as noted, would cause more harm than good to the population.

However, nothing stands in the way, or rather, it is imperative that, with prior planning, these questions are included in the Censuses for years to come”, determined the judge.
