Regera is also looking for people who have been harmed by the company's Batterygate. apple – alleged intentional restriction by the company to reduce the performance of older iPhones (6, 7 and first generation SE). In addition, it is also looking for drivers who were affected by Volkswagen's Dieselgate – the company would have defrauded the pollutant gas emission sensors in Amarok pickup trucks.
I bought my iPhone and it came without a charger in the box! What to do?
By law, you can file a lawsuit against Apple. But, even if this is not its intention, Regera is willing to pay compensation and pursue its rights. The startup's goal is to make big companies walk the line and not make a fool of consumers.
For this, the company makes two proposals: file a lawsuit in its name and, after the action is judged, keep 30% of the compensation – taking care of all the bureaucratic part; or pay an amount in advance to the consumer, regardless of the result of the action – however, if the verdict is favorable, the startup keeps the entire amount.
According to an investigation by the Tecnoblog website, the R$ 300 are offered in cell phone cases without a charger or Batterygate. In court, compensation can reach up to R$ 3,000, but the result can take from five to ten years.
In the case of Dieselgate, the company is willing to pay BRL 1,540 in advance and the compensation is around BRL 25,000. The trial waiting time is the same.
In both cases, taking the matter to court can cost you more money, but so does the waiting time.
Should I take the money now or later?
Bruno Dollo, founder of Regera, told Tecnoblog that, in the case of cell phones, most people prefer to receive the money right away. According to him, only a third of consumers wanted to wait for the outcome of the trial.
However, the opposite happens in cases involving Dieselgate. About a third preferred to accept the startup's immediate cash proposal. After all, the value can be much higher after the judge's verdict.
