The new rule allows signal jammers to be applied in airports, military areas, public security areas, ports and other places of public security agencies. The current rules change what had been edited in 2002. To enter into force, publication in the Official Gazette of the Union is sufficient.
The request for the blockers could only be made by the Ministry of Justice, which was also changed by Anatel this year. Now, the application resources have also been expanded, as in addition to the Ministry of Justice, the Institutional Security Office (GSI), the President of Brazil, the Armed Forces, the Ministry of Defense and the Ministry of Foreign Affairs may also apply the blockers.
The only rule is to place the order 15 days before the day required for installation. The only bodies that can request blockers for immediate use are the GSI, the Armed Forces, the Ministry of Defense and the Presidency of the Republic.
Resources are prohibited for any company or individual, even if they participate in public bodies. Only those mentioned may apply for blockers. Anatel informs that the installation of blockers without the agency's authorization constitutes a crime of clandestine activity, under penalty of 2 to 4 years in prison.
