Bolsonaro ineligible: know what ineligibility is and what the Brazilian electoral system is like

The Superior Electoral Court (TSE) ruled today, June 30, that former President Jair Bolsonaro is ineligible for eight years. The decision was in majority, with four votes of ministers against two.

Bolsonaro will be ineligible after telling lies and attacking the Brazilian electoral system. He will only be able to run again in 2030, that is, he will be away for three elections.

Bolsonaro's trial will still have the votes of the president of the TSE, Alexandre de Moraes, and minister Nunes Marques.

What is ineligibility?

According to the TSE glossary, ineligibility is the temporary impediment of the citizen's electoral capacity, which consists of the restriction of being voted, due to the framing in any of the hypotheses provided for in the Law of Ineligibility and in the Constitution Federal.

The TSE points out that ineligibility does not affect the citizen's other political rights, such as voting and participating in political parties.

How was the decision to make Bolsonaro ineligible?

The decision to make Bolsonaro ineligible began this morning (30). The trial of the former president was resumed, after four previous sessions, with the vote of the Minister of the Federal Supreme Court (

stf), Carmen Lucia.

The minister said that the former president made serious attacks on the ministers of the TSE and the STF. According to her, criticisms of the Brazilian judicial system can be made, but not "feelings".

Last Tuesday (27), TSE Minister Benedito Gonçalves stated that Bolsonaro had to be condemned for abuse of political power and misuse of the media. Two days later, other ministers, Floriano Marques and André Tavares, gave the same opinion.

Only Minister Raul Araújo voted for Bolsonaro's acquittal.

Why was Bolsonaro tried?

Former President Bolsonaro was tried for having attacked the Brazilian electoral system during a meeting at on the eve of the beginning of the electoral period in 2022, at the Palácio da Alvorada, which was attended by ambassadors foreigners.

At the meeting, Bolsonaro also made statements that were considered fraud and, therefore, were denied.

How does the Brazilian electoral system work?

The Brazilian electoral system works by choosing the country's government representatives in the Legislative and Executive branches. Their choice is made by popular vote, the means by which the population is able to participate directly in the Brazilian political process.

This system was established in the Federal Constitution of 1988, and its operation is the responsibility of the Superior Electoral Court (TSE). The choice of rulers and popular participation by vote take place in elections, held in our country every two years.

In 2022, he was the first president of the New Republic to seek re-election and be defeated.
