Optional point is the decree carried out by governments which consists in dispensing with the obligation to operate their bodies on days of certain commemorative dates.
Normally this decree is valid for employees of municipal, state and federal levels of governments, but private companies can also adopt this measure. Each sphere of government is responsible for enacting the optional points relating to the bodies that make up the local public administration.
Thus, in relation to private companies there are no impediments to work on days when the optional point is decreed by the government. Thus, the employer has no obligation to release employees from providing services and it is up to him to decide whether to accept the optional point or not.
In this situation, the optional point can also be agreed between the employer and the employees, for example, a working day may only have part-time work.
Difference between Optional Point and Holiday
Many entrepreneurs and workers still make some confusion between the concepts of holiday and optional time. And both can also have joint functions, but still, they have their differences.
O Facultative point is the one in which the employer can decide whether or not to give their employees the day off. already the holiday it is a date decreed and made official in the national, state and municipal calendars, making mandatory dismissal of service on these days.
In some situations, the law allows work on holidays and in these cases employees must receive double payment, as determined by the Consolidation of Labor Laws (CLT).
In Brazil, the issue of work on holidays is regulated by the CLT and by law No. 605 of January 5, 1949.
