Meaning of Unborn (What it is, Concept and Definition)

unborn is the one that will be born, what it was begotten and not born yet.

It is considered synonymous with the fetus and there is great controversy as to whether, despite having life, a fetus can be considered a human being and what rights this being has.

In other words, the unborn is the being already conceived and ready to be born, but still in the mother's womb.

Etymologically, this term originated from the Latin nasciturus, which means "that must be born".

In Brazil, the Day of the Unborn was created, which is celebrated on March 25th. The choice of this date coincides with that of the celebration of the Annunciation, that is, the news brought by the Archangel Gabriel to Mary, that God had chosen her to be the mother of Jesus Christ.

O birth day aims to make people aware of the risks that children run from conception to birth.

Right of the Birth

Article 2 of the Brazilian Civil Code establishes that the unborn child has his rights guaranteed by the law from its conception, but the fetus will acquire civil personality only when born; come out of the womb.

Status of the Unborn

On June 5, 2013, the Chamber's Finance and Taxation Committee approved a replacement for Bill 478/2007.

This substitute institutes the Status of the Unborn, which grants children who are born due to sexual abuse, for example, the right to receive child support (in the amount of one minimum wage).

The support may be granted until the child is born or until the child is adopted. Another proposal suggests such financial help during the first trimester of pregnancy.

If the child's biological father is identified, he must pay support. Otherwise, the State must pay the pension.

The Unborn Child Statute states that it is “duty of the family, society and the State to ensure the unborn child, with absolute priority, the right to life, health, development, food, dignity, respect, freedom and the family, in addition to keeping you safe from all forms of negligence, discrimination, exploitation, violence, cruelty and oppression”.

The debate on this proposal was closely followed by groups of women's rights advocates (against the proposal) and also by groups against abortion (in favor of the bill).

Before entering into force, the proposal will have to be analyzed by the Constitution and Justice Committee, by the Senate and will have to receive presidential approval.
