Labor agreement consists of a form of claim by a worker in relation to his employer. It also means the same thing as discord, dissent, dissension and disintelligence.
This term is used in the context of labor law, which refers to the lack of convergence between workers and employers. The bargaining can be individual, when discord occurs between a worker and the employer, or it can be collective, in case of conflict between a specific category of employees and a specific category of companies.
Collective bargaining often occurs because of the salary increase of employees, and may also be known as wage bargaining. When the two parties involved cannot reach an agreement, the situation is referred to the Labor Court.
there can only be collective bargaining after a real attempt at negotiation between the parties involved. When there is a collective bargaining agreement, certain unions that are responsible for defending the interests of a particular class of workers are normally involved.
When there is no chance of negotiation, it is possible to establish a collective agreement, resorting to the Labor Court. When the collective bargaining is instituted, both parties are encouraged to reach an agreement, so that in this way it can resolve the issue of the collective bargaining.
In the case of salary increases, when collective bargaining does not work, collective bargaining occurs. For example, if a group of workers wants to get a 5% wage increase and employers do not agree, a collective bargaining agreement is usually established, sending the final decision to the power judiciary.
How to calculate the wage increase
The value of the collective bargaining agreement (salary adjustment) is made by the judiciary, based on the current salary.
The calculation of the wage increase is done as follows: SR = SA + (SA x R)/100.
SR: Adjusted Salary.
SA: Current Salary.
R: salary adjustment percentage value.
For example, if an employee has a salary of R$ 2,000.00 and received a 5% wage increase, then the readjustment will be R$ 100.
SR = 2000 + (2000 x 5)/100
SR = 2000 + 10000/100
SR = 2000 + 100
SR = 100.
Thus, the readjusted salary (SR) will be R$ 2,100.00.
However, if the employee has not completed one year at the company when he receives the salary increase, this is proportional to his/her length of service until that moment.
For example, if the readjustment is 5% and the employee has only 6 months of service, then he will receive only 2.5% (6/12).
To calculate the retroactive payment amount it is necessary to multiply the amount of the increase by the number of months since the base date on which the worker was admitted to the company.
Retroactive payment = amount of increase x number of months.
PR = 100 x 14 = R$ 1,400.00.
