The justification behind this proposal is to correct what is considered a distortion and injustice in relation to workers' rights, as indicated by the authorities.
FGTS may change soon
According to current rules, workers who have signed up to the birthday withdrawal have the right to make annual withdrawals of part of their FGTS balances, in the month corresponding to their birthday.
However, in cases of unfair dismissal, only the amount related to the termination fine can be obtained.
The Ministry of Labor estimates that implementing this change could result in a financial impact of up to R$14 billion.

It is important to note, however, that the proposal is subject to review and approval by the president Luís Inácio Lula da Silva (PT) before being sent to the National Congress to become effective.
Luiz Marinho, Minister of Labor, took office with the commitment to eliminate the birthday withdrawal modality, which he considers harmful to workers.
However, given the possibility of facing resistance in the Congress, Marinho expressed his intention to review the measure, seeking alternatives that meet the interests of workers in a balanced way.
