A historic decision by Brazilian justice is causing great repercussions. Caixa Econômica Federal and other federal government bodies were ordered to compensate around four million beneficiaries of the Auxílio Brasil program due to a data leak that occurred in October of the year past.

According to judge Marco Aurélio de Mello Castrianni, there is evidence that citizens were contacted with the aim of influencing their choice of candidate, under the threat of losing the benefit of the Brazil Aid. This allegedly irregular behavior led to the decision to compensate victims of the leak.
Violation of the LGPD and collective moral damage
The data leak not only exposed personal information, but also violated the General Data Protection Law (LGPD).
The leaked data was allegedly being used by financial institutions to offer credit, real estate financing and other activities related to the program, without the due consent of citizens affected.
In addition to individual compensation, the court decision also imposes the payment of R$40 million for collective moral damages, which will be allocated to the Fund for the Defense of Diffuse Rights.
This fund, which is part of the public administration, has the mission of repairing damages caused to consumers, the environment, the economic order and other aspects of common interest.
Impact on public administration
The decision not only covers Caixa Econômica Federal, but also the Union, the National Data Protection Agency (ANPD) and Dataprev, the information processing service of the federal government.
The legal action was initiated by Instituto Sigilo, an organization dedicated to the defense and protection of personal data and consumer rights.
