What is Military Intervention?

In Brazil, it is foreseen in the Constitution of 1988, at the Title V, Chapter I, Sections I and II, the implementation of military intervention, only in three cases:

  • “The defense of the State and Democratic Institutions; The State of Defense and the State of Siege”.

That is, the only three cases that allow the execution of a military intervention in Brazil are in the case of Federal Intervention, State of Defense and State of Siege, when public order or social peace is threatened by some institutional instability or calamity.

Federal Intervention

State of Defense

This type of intervention only happens in an emergency situation, when some individual guarantees guaranteed by the Constitution are suspended. This can happen in cases of Institutional crisis and wars.

State of siege

O State of siege happens when the head of state suspends the performance of the Legislative and Judiciary powers, in an emergency situation.

With that, this intervention works in situations of need to make quick and efficient government decisions, hence the suspension of the Legislative and Judiciary.

This type of intervention cannot happen for personal purposes or to dispute power.

Military Intervention in Brazil

In 1964, there was a military intervention and to this day there is much debate about whether it was a constitutional intervention or a coup. At that moment in the country, there was a lot of military and political discontent with the then president João Goulart.

The issue is that there were no justifications based on or supported by the Constitution in force at the time, the Constitution of 1946. So this intervention was actually a Military Coup of 64, which lasted 20 years.

The movement took place in a way that two fronts were mobilized in the country, one in Rio de Janeiro, commanded by General Costa eSilva, and another in Minas Gerais, led by General Olimpio Mourão Filho.

All military action was the result of dissatisfaction and personal political convictions of those who led the coup, in view of the perception they had about the situation in the country. Also because there was no formal request to the National Congress for a military intervention against President João Goulart.
