Every year, the amounts retained in the Severance Indemnity Fund (FGTS) undergo a monetary review provided for by law. According to this rule, the amounts must be in accordance with the Referential Rate (TR). In the year 2021, however, this rate was equivalent to 0% and caused many accounts not to be adjusted correctly. The review and the Reference Rate
The TR, or Referential Rate, is a reference interest rate and social indicator of the Brazilian economy. It was created in 1991 and it is based on it that the value of interest on public accounts and savings is calculated.
In 2021, however, with the financial crisis experienced by the country, these interest rates were 0%. This directly affected the way readjustments took place, leaving many workers without a proper review.
Thus, with the new release of the FGTS installment, workers who did not obtain the review can request and receive up to R$ 10,000. See below for the steps to apply.
How to request a review of your FGTS?
Currently, there is no department responsible for handling review requests. The only way to really get your request taken into consideration is with a lawsuit, with the Federal Special Court.
For this, it is important to look for the closest one to your city and take documents such as: identity card, CPF, work card and FGTS income information. As this is a case before the Federal Court, it is not necessary for the citizen to be accompanied by a lawyer.
Finally, it is worth mentioning that the review ceiling is 60 minimum wages (R$ 72,000). If the worker wants to check how much it is possible to earn with the revisions, he can simulate the amounts in the LOIT FGTS.
