Does the chemical dependent have a benefit guaranteed by the INSS?

What qualifies as a chemical dependent?

According to the World Health Organization, chemical dependency is a disorder characterized by the use uncontrolled use of one or more psychoactive substances, i.e., resulting in changes in the mental state of A person.

The main characteristic of drug users is the ability to maintain a certain balance when consuming illicit substances. Thus, the difference is established in this ability to control the desire to use drugs, considered a missing factor in drug addicts.

Which INSS benefits can be requested?

The INSS does not have the right to differentiate the insured persons under its care and also in their medical expertise. Therefore, see below the benefits allowed for chemical dependents:

  • sick pay

The request for this benefit can be made by the insured person if he is unable to carry out work activities due to the condition of chemical dependency. However, he must be contributing to the INSS or, at least, that he has not stopped contributing for more than a year.

In addition, by law, policyholders must meet the grace period required to receive this benefit: 12 days of monthly contributions and being unable to work or perform day-to-day tasks for more than 15 days in a row.

  • By disability retirement

This benefit can be granted if the incapacity for work due to this dependency is considered permanent. In addition, the insured must also have a grace period of at least 12 months for contributions.

  • Continuing Provision Benefit - BPC

If it is impossible to work because of the illness, but there has been no minimum contribution to the INSS or if you have never contributed, the individual may apply for the Benefit of Continued Benefit (BPC).

However, to receive this benefit, some factors are taken into account:

  • Monthly household income of less than ¼ of the minimum wage;
  • Higher degree of severity of the disease;
  • Not having another benefit under the RGPS or another regime;
  • Be registered in the Cadastro Único (Cadùnico).
