Unemployment insurance
If you are dismissed from your job without just cause, unemployment insurance is a guaranteed right for workers. This benefit is part of the severance pay that is usually paid when an employment contract is terminated.
Thus, even if temporary, having to be paid between 3 and 5 monthly installments, this benefit is a relief for those who have just lost their job. CLT workers, professional fishermen, domestic workers and those rescued in situations analogous to slavery are entitled to apply for unemployment insurance.
FGTS
Every worker hired under the CLT regime has an amount deposited monthly into his/her account with the Severance Indemnity Fund (FGTS). Thus, the available balance will serve as aid in the future, in case of dismissal.
Among the conditions that make it possible to withdraw this amount is dismissal without just cause. In addition, by being able to withdraw the entire amount of the FGTS, the worker is entitled to accumulate an additional 40%, which is the fine on the balance. Those who have been unemployed for more than three years in a row, without any employment relationship with CLT, will also be able to withdraw the amount.
BPC/Loas
Finally, there is the Benefit of Continuous Provision (BPC), which assists seniors over 65 and people with disabilities of any age. To receive the benefit, interested parties must be unemployed and have a per capita family income of up to ¼ of the current minimum wage.
That is, in values updated by the minimum wage of 2022, this value corresponds to an income of R$ 302.50 for each person. In addition, the family must have an up-to-date record in CadÚnico, where the government counts vulnerable families.
