The Federal Government gave 20 days for the technology giant, Apple, to pronounce before the Ministry of Justice on the iPhones that were being sold without chargers in the country. Since 2020, the company no longer includes the cable and connector in the box of the much-desired smartphones.
This action has become an unprecedented annoyance for many customers and users of the brand. The National Secretariat for Consumer Protection (Senacon) recognized the practice as abusive, framed as a “tied sale” and fined the company R$ 11 million. Government is in the battle against the sale of iPhones without the charger
This is the newest chapter in the war against the sale of iPhones without chargers in Brazil. This battle is even included in the Official Gazette of the Union.
This Wednesday's edition (29) brings the deadline of 20 days for the company to express itself on the situation that is occurring. The order of substitute director Frederico Moesch directs state and municipal Procons to organize themselves to take appropriate measures regarding the practice.
Senacon recognizes the practice as a “tied sale” prohibited by law
Representatives of Senacon explain that the iPhone without the cable and without the plug adapter conditions the purchase of the product to the purchase of another item that is sold separately, which is the case of chargers. Therefore, it is a tied sale “due to the fact that it imposes, albeit indirectly, the purchase of a good in order to use another”, informed the agency.
IPhone case without chargers
Apple stopped including the charger in all its devices since 2020, after announcing the new iPhone 12. However, this was done under the statement that the decision is part of the "environmental objectives" of the brand.
At the time, Procon-SP questioned the manufacturer to obtain more explanations about how this sale would work.
In November, the agency stated that “the company has not demonstrated any environmental advantage or gain” in its first pronouncement, since it did not present any plan for the collection of old equipment and recycling.
Now, Procon says it has not received an answer to questions such as whether there was a reduction in the price of the iPhone 12 device, due to the withdrawal of the accessory; what are the values of the device sold with and without the adapter and the effective reduction in the number of adapters produced. Finally, consumers are still required to purchase a charger from the company in order to be able to use their device.
