Nursing floor: Barroso says suspension was given to find source of funds

After the STF session, Justice Luís Roberto Barroso informed that the decision to suspend the payment of the basic salary for nursing had the goal to create a form of funding that would enable compliance with the law. He also informed that he thinks the implementation of a floor for professionals is fair, therefore, he is committed to it.

“My view and that of many is that, without having a source from which to draw the money, it ends up becoming very difficult to get this salary floor off the ground. However, my initial concern is not to let fair recognition for these health professionals, who were tireless during the pandemic period, end up being a fiction.”

Still according to information provided, at the time when Barroso ordered the suspension of the floor, there was a great real and imminent risk of general non-compliance with the law.

“Many hospitals have already started mass layoffs in advance due to the difficulty of complying with the floor. Important social works said they would be closing their doors. The Santas Casas, if they managed not to close, were already pointing out that they would have a reduction in service. The hospitals affiliated with the SUS were waving mass dismissals”, added the minister.

It is also worth mentioning the meeting in which Barroso met with the president of the Senate, Rodrigo Pacheco, to talk about this topic, which ended on Tuesday. The two were in a meeting for approximately an hour in the minister's office, who is the rapporteur in the Supreme Court of this action that ended up suspending the law.

Possibilities have been raised

In a note that was released shortly after the meeting, it was said that the two are in agreement on defending the importance of the need for the floor, however, they also “agreed on the need for a source of funds to manage to make the payment of wages viable at a level Minimum".

“Three points were highlighted as a possibility: correcting the SUS table; exemption from the sector's payroll; and the compensation of the debt of the states with the Union”, they affirmed through the note.

After the meeting with the minister, Rodrigo Pacheco said that the national nursing floor became an absolute priority for Congress and that this correction in the table SUS, which depends solely on the Executive Branch, is what appears to be the most viable way for them to accept payment of the minimum wage.

Still according to Pacheco, the table should have been corrected a long time ago.
