The Chamber of Deputies is analyzing the Emergency System 927/2022, from Bill (PL) No. 1.774/2019, authored by Deputy Glaustin by Fokus, from PSC/GO, which aims to authorize the sale of over-the-counter medicines in supermarkets and similar establishments, which amends Federal Law No. 5,991/73, which determines the sale of these medicines exclusively in pharmacies and drugstores.

The exclusive sale of medicines in pharmacies and drugstores generated, in 2021 alone, revenue of R$ 13 billion for the Brazilian Association of Pharmacies and Drugstores Chains – Abrafarma. According to the entity itself, the prices of over-the-counter medicines, herbal medicines and supplements are established by the pharmacy or drugstore itself. However, those that need a prescription are regularized by the Chamber for the Regulation of Drug Prices – CMED.
