The victim reports that she was sought after by her former employers when she lived in a shelter. Work started at 6 am and ended at 11 pm daily, with over 12 hours of housework. She took care of the house, all the tasks around the environment, and even worked as a nanny for her employers' young son. When she was removed from the shelter, the proposal was that the woman would have access to a minimum wage.

On the other hand, the victim claims that he never received the promised salary and also never had the right to vacation or any kind of rest for 30 years. The complaint was made through the Specialized Reference Center for Social Assistance (Creas-Mooca), a lawsuit filed by the Public Ministry of Labor (MPT).

The couple's defense, the worker's employers, claims that the process is nothing more than an "exaggeration", as they had a family environment for the woman to work, granting affection, dignity and welcome during the years of work. They also highlighted that the woman was removed from the street situation to work in the residence.

In addition to these observations, they added that the maid had the right to go where she wanted, but she preferred to stay at home doing her duties. According to the note published in the Regional Labor Court of the 2nd Region (TRT2), there has been no employment relationship in three decades.

“A first attempt to receive the aid took place in 2014 at the same institution. At the time, there was a conversation with the couple and it was agreed that they would register the victim's employment relationship and pay the labor credits owed, which was never fulfilled,” said the TRT.

The couple, according to the judge's decision, need to register in the housekeeper's work card from from January 1989 to July 2022, with a monthly salary of R$ 1,284 referring to the minimum wage for the year past. For each day of non-compliance, there will be a fine of R$ 50 thousand.

“Work in a condition analogous to slavery takes on one of its cruelest faces when it comes to domestic work. Obviously, the worker without salary for more than 30 years does not have full freedom to come and go. She is unable to break the abusive relationship of exploitation of her work, since she lacks the minimum conditions of subsistence far from the employers' residence, without the means to determine the direction of their own lives", said the judge when taking the decision.
