On December 21 of the previous year, the project that guarantees the inclusion of cannabis-based medicines in the Unified Health System (SUS) in São Paulo, had been approved by the Legislative Assembly of the State of São Paulo (Alesp), having been proposed by deputy Caio França (PSB). Now, on January 31 of the current year, the law was sanctioned, despite partial vetoes.
Caio França celebrated the achievement on his social networks, saying that it was a victory for the various families “of autistic people, people with rare syndromes,
Parkinson's and other pathologies”. On Monday, the 30th, the deputy delivered a petition, comprising 40,000 signatures, accompanied by notes of support, to the governor of the state of São Paulo, Tarcísio de Freitas.This law should be sanctioned or vetoed by February 3, Friday. However, despite being sanctioned, the partial vetoes, according to what was informed by the government, were made with based on the Federal Constitution of 1988, since some parts of the new law were in disagreement with the letter magna. Impacts of the availability of medicines in the SUS
This measure aims to reduce the financial impacts derived from judicialization, since, despite being provided since 2015, it was necessary to have a court decision favorable to the importation to only then have the drug available for use.
This procedure took time and money, but now the SUS itself will provide them, thus ensuring the safety of patients who need medication based on cannabis, which has already been approved by the responsible health authorities.
Now, the government of the state of São Paulo will create an exclusive working group to regulate and put into practice the new law, as informed in a note: “Professionals will be responsible for implementing, updating and reassessing the State Policy on Drugs Formulated Based on cannabis”.
