What does the text say
The original text, authored by Deputy Vinicius Carvalho, of the Republicans of São Paulo, initially prohibited the employment relationship between ministers, pastors, elders, bishops, nuns, priests, evangelists, deacons, elders or priests and their respective religious confessions, such as churches, institutions, orders or congregations.
However, the project's rapporteur in the Senate, Senator Zenaide Maia, from the PSD of Rio Grande do Norte, proposed a more comprehensive wording, including all the religions, and his amendment was accepted.
The proposal aims to prevent volunteers, who work in religious institutions, from filing labor lawsuits years later in search of recognition of labor rights.
These people often carry out voluntary services motivated by their faith and, later, seek recognition of the employment relationship in the Labor Court. The measure intends to bring legal certainty and avoid the accumulation of these actions in the courts.
Expectations with the presidential sanction
Damares Alves, senator for the Republican Party of the Federal District and member of the Evangelical Parliamentary Front, highlighted that the project is important to avoid labor lawsuits by opportunists who join religious communities with intentions questionable.
According to her, many volunteers carry out activities related to the administration of religious entities, such as the celebration of Holy Communion or the Eucharist, and subsequently filed labor lawsuits against the denominations.
The project's approval also received praise from senators Zequinha Marinho, from Podemos in Pará, and Izalci Lucas, from the PSDB in the Federal District.
Both highlighted the importance of the measure to bring legal certainty to religious institutions. Now, the project awaits the presidential sanction to enter into force.
If sanctioned, the new law will guarantee that there will no longer be an employment relationship between religious entities of any denomination or nature and their ministers, priests, priests, pastors and other religious representatives, even if they are involved in activities related to the administration of institutions.
