The new traffic rules came into force in the country in April 2022. The new Law nº 14.229/2021, published in October 2021, brought significant changes that alter Brazilian traffic rules, which have been gradually implemented in the country. Modification of traffic fines
Some rules are already in effect, while others will be implemented from January 1st of next year. For example, changes that are effective include overweight fines, company sanctions and changes in the license suspension and revocation process (National Driver's License - CNH).
Overweight
This change is related to how vehicle overweight notifications are enforced. Initially, charges were based on the number of truck axles and, if they exceeded the permitted limit, fines were applied.
However, under the new established rules, fines will be calculated based on the total gross amount. That way, when there are imbalances due to poor load distribution, drivers will not be penalized.
Suspension of penalties
The second amendment provides for a moratorium on penalties during the review of motorist appeals against fines. The rule was previously introduced by a resolution of the National Transport Commission (Contran) and now has the force of law to be included in the Traffic Code.
Previously, however, infraction points were not recorded in the medical record throughout the appeal judgment process. The same was applied when suspending and withdrawing cases. Now, while the appeal awaits hearing, drivers can drive, renew their state driver's license, request a copy, and more.
About vehicle drivers
This last change was beneficial for companies that have fleets. Before the change, when an agency was fined for not specifying who was driving a vehicle, the amount charged was multiplied by the number of times the same infraction occurred in the year previous. Now, in cases of recurrence, the fine will only be doubled.

- Enter the official website of the Detran (of the state in which you live);
- Then, access the specific area of the site for querying fines;
- Finally, enter the requested information, such as license plate and Renavam, and make the query.
